The uploader of this file cites Flickr as this file's source. The name of the uploader on Wikipedia and the uploader on Flickr are most likely the same person, given their similar names on both cites. On Flickr, the uploader has claimed that the image was uploaded with a free license that is compatible with Wikipedia per Wikipedia:Upload/Flickr. However...

...There is not proof that the image's obvious copyright holder, Tarlac State University, has released any part of their logo with a free license at all. In a nutshell, the free license claim made on Flickr seems bogus as a copyright infringement as a republishing of their work or the creation of a derivative work. MUST NOT BE DELETED. The author that uploaded the file is same as the one who created this word mark and it was uploaded on Flickr (by the owner) for public use. It was created for Tarlac State University's wikipedia article. @Jcmpineda: What you just said means that the author created this image as a derivative work that incorporates the logo of the university, which is a copyright of the university since it (the logo) is owned by the university. This means that unless proof can be provided stating that the university released their logo or its likeness as a free file (see WP:CONSENT), this is a derivative work with the non-free logo in it, making the entire image non-free. (In other words, the author of this image cannot claim full copyright of this image, so it cannot be released as a "free image" by them legally.) Steel1943 (talk) 11:14, 12 January 2016 (UTC)[reply]
@Steel1943: The logo that was used is not basically owned by the university since it is a modified one. This is the original logo of the university: http://www.tsu.edu.ph/media/1902/TSUC_250x250.jpg. You can say that it might be a copyright infringement, but still, it is made for Tarlac State University, and there is no claim that the logo shall not be used for certain purposes. Jcmpineda (talk)

Delete There is no claim of a free licence on Flickr. There is a claim on Flickr that the picture is in the public domain worldwide through copyright expiration, which typically means that the picture was published before 1923 and created by someone who died more than 80 years ago. However, there is no information about the year of first publication or the death year of the author, so the information can't be verified. --Stefan2 (talk) 14:45, 12 January 2016 (UTC)[reply]

And it was uploaded for the only purpose of placing it as Infobox profile image of Tarlac State University since the previous one was also deleted. @Jcmpineda: This does not address my copyright concern. For reference, please see threshold of originality. Also, on this Wikipedia, an image can only be hosted as "free" here if it would not be eligible for copyright in the United States, regardless of its origin (and, in this case, it does originate from the United States since the university is in Albuquerque, New Mexico, which is located in the United States.) In the image, the gear, owl, sun, leaf, and hands are "too original" (more that just shapes like circles and squares.) Steel1943 (talk) 11:19, 12 January 2016 (UTC)[reply]
@Steel1943: The university is actually located in the Philippines. I think that the image was uploaded by Tarlac State University on their official website for public use. I do not want to violate any copyright rule here, but I cannot find a way to put a logo for the university's wikipedia article because there is no existing image of the logo in wikipedia and in commons. Delete Wikipedia lists the file as being in the public domain by virtue of being below the threshold of originality, but this is obviously not the case. There is also a link to Flickr, where it is listed as 'cc-pd' (i.e. author died more than 80 years ago, first published before 1923), but there is no evidence that the tag on Flickr is valid. --Stefan2 (talk) 14:49, 12 January 2016 (UTC)[reply]
